These terms cover your use of the gusty.ai website. They do not cover the delivery of GUSTY software or services — that sits in whatever contract we sign with you, and that contract wins wherever the two disagree.

In these terms, "GUSTY", "we", and "us" mean that company. "You" means anyone who visits or uses this website.

Accepting these terms

Using this website means you accept these terms. If you do not accept them, stop using the site. If you are visiting on behalf of an organisation, you confirm you are allowed to accept these terms for that organisation.

What these terms do not cover

These terms apply to the website and nothing else. They are not a licence to use our software and they are not a subscription agreement.

Use of GUSTY software, SaaS subscriptions, implementation services, support and maintenance services, and any customer-specific arrangement are governed by separate commercial agreements between GUSTY and the customer. Those agreements set out the licence, the service levels, the fees, the data processing arrangements, the warranties, and the liability that apply to them. Nothing on this page creates, replaces, extends, or limits any of it, and where these terms and a signed agreement disagree, the signed agreement applies.

What this site is

This site describes what GUSTY does and publishes our thinking on maintenance operations. It is information, not advice. The insights, benchmarks, and examples here are written from general experience with heavy asset operations, and your operation is not the one we had in mind when we wrote them.

Do not make a maintenance, safety, staffing, or investment decision on the basis of a page on this website alone. If you want a view on your specific situation, talk to us and we will give you one properly.

Nothing here is an offer

Descriptions of solutions, capabilities, and outcomes on this site are not a binding offer and do not form a contract. Scope, pricing, and any commitments about results exist only in a signed agreement.

Using this site

You may use this website to read what we publish, to evaluate whether GUSTY fits your operation, and to get in touch. That is what it is for.

You may not use it in a way that breaks the law, interferes with the site or the people using it, or takes it apart for someone else's benefit. Concretely, do not:

• attempt to gain access to any part of the site, server, or system you are not meant to reach;
• probe, scan, or test the security of the site, or work around any access control;
• introduce malware or anything else designed to disrupt or damage;
• overload the site with automated requests, or scrape it at a scale that affects its operation;
• harvest personal data of anyone from the site;
• impersonate GUSTY or misrepresent your relationship with us.

We may restrict or block access if the site is being used this way.

Our content

The text, images, wordmark, and design on this site belong to GUSTY or are used with permission. You may read it, share links to it, and quote it with attribution. You may not republish substantial parts of it as your own, or use it to train models or build a competing offering, without our written permission.

What you send us

When you send us a message through the contact form, keep it lawful and keep it yours to send. Do not send confidential information belonging to your employer or a third party through a web form — if there is something sensitive to discuss, we will set up a proper channel first.

Links to other sites

Where we link out, we are pointing at something we found worth reading. We do not control those sites and are not responsible for what they do or what they later become.

Availability

We keep this site running but do not promise it will always be available or always be current. We may change or remove content at any time.

No warranties

This website and everything on it are provided as they are. To the extent the law allows, we make no warranties about it — not that the content is accurate, complete, or current, not that the site will be uninterrupted, secure, or free of errors, and not that it fits any particular purpose you have in mind. Any warranty implied by law is excluded as far as it legally can be.

Warranties covering GUSTY software and services are a separate matter and live in the commercial agreement that covers them.

Limits of our liability

To the extent the law allows, GUSTY is not liable for loss arising from your use of this website, from reliance on its content, or from the site being unavailable. This includes indirect and consequential loss, lost profit, lost production, and lost or corrupted data.

Nothing in these terms limits or excludes liability that cannot legally be limited or excluded — including liability for death or personal injury caused by negligence, or for fraud.

Privacy

What personal data we collect through this site, why, and what you can do about it is set out in the Privacy Policy, which covers our use of cookies as well.

Changes to these terms

We may update these terms. The date at the top tells you when we last did. Using the site after a change means you accept the current version.

Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of Dubai.

If you are a consumer in a country whose law gives you protections that cannot be contracted away, this clause does not remove them.
